Offer In Compromise
Many people qualify for Offer in Compromise settlements. Assuming that you do qualify for an Offer in Compromise it would probably be in your interest to pursue this type of resolution of your IRS tax debt.
There are three types of Offer in Compromises:
1. The IRS will accept an Offer in Compromise based on "Doubts as to liability". This means that if it can be demonstrated that you don't really owe the taxes that the IRS claims you owe then the IRS will absolve the tax debt.
2. The IRS will accept an Offer in Compromise based on "Doubts as to collectible". This basically means that you can demonstrate to the IRS that they can not expect you to be able to pay the full debt within the next five years.
3. The IRS will sometimes accept Offer in Compromise based on "the tax administration clause". This generally means that the taxpayer has sufficient assets to pay the existing debt, however if he/she does not pay the full debt it would create a hardship for the taxpayer.
In most cases the IRS allows tax-payers to take advantage of the Offer in Compromise program so they can collect at least a portion of what is owed and be reasonably assured of collecting the full amount of annual tax debts in the future. One of IRS' criteria for accepting an Offer in Compromise is that the taxpayer agrees to file and pay all taxes on time during the next five years. In other words if you can discipline yourself to file and pay your taxes on time for the next five years then an Offer in Compromise would be your best option.

The Form 2848 is specific to the IRS and does not give the United Tax Relief power of attorney over any other aspect of your life, such as banking and business affairs.
***Form 2848 is a Power of Attorney and Representation document that is specific to the IRS. This means that while our attorney will be able to speak and correspond with the IRS on your behalf, he/she does not have Power of Attorney in any other aspects of your life, i.e., your bank accounts, business and personal affairs, outside of your dealings with the IRS
Penalty Abatement
A Penalty Abatement is another program which can effectively reduce an outstanding tax liability. This means that the IRS will agree to abate penalties and their associated interest that have accumulated on your tax debt. If you have a tax debt that derived during a time of hardship which caused you to be unable to pay your tax debt, you may qualify for this program by showing that there was "reasonable cause" (you had a valid reason for the delay in filing and/or paying the debt), "no willful neglect" (you did not purposely neglect to file and/or pay the subject taxes in a timely manner) and you exercised "due diligence" (making every effort to file and/or pay the subject taxes in a timely manner).
Generally the IRS will only abate the interest on the principle balance portion of your tax debt if it can be demonstrated to their satisfaction that the IRS made an error relative to your assessed taxes in one or more years for which you owe taxes.
Many tax-payers have circumstances beyond their control that cause the inability to file their tax returns and/or pay the taxes when they are due such as death, serious illness, drug or alcohol addiction, unavoidable absence, divorce, natural disasters, fire, casualty, embezzlement, inability to obtain necessary records, reliance by the taxpayer or erroneous advice by the IRS or a competent tax advisor, etc.
